Permission for Charter Flights
Requirements and exceptions for submitting the application according to § 14 BGzLV:
Community air carriers do not require authorization from Austro Control GmbH for flights within EU member states.
Air carriers from the Community may only carry out commercial transportation of passengers or cargo on non-scheduled flights to and from third countries (i.e. countries that are not members of the European Union or are not treated as such by intergovernmental agreement) if a permit has been issued by Austro Control GmbH.
Air carriers from third countries may only carry out commercial transportation of passengers or cargo within the framework of non-scheduled air traffic if a permit has been issued by Austro Control GmbH.
No authorization is required:
Flights for the purpose of fulfilling humanitarian obligations or providing assistance in emergencies.
Flights to be operated by Community air carriers with aircraft with a maximum take-off mass of up to 14000 kg and
Flights in accordance with Article 2 of the Multilateral Agreement on Commercial Rights in Non-Scheduled Air Transport in Europe.
Prerequisites: Non-Objection
For applications by a non-EU air carrier for approval of 7th freedom flights from Austria, the applicant must provide proof that the Austrian air carriers in the relevant category have been contacted and have been given the opportunity to object to the respective applicant and to offer the service for the requested flight themselves.
Exceptions are: 7th freedom flights to and from Austria, as well as operators that fall under the Paris Agreement and transport within the Paris Agreement countries.
Required documents
For the online service you need:
- EASA TCO authorization of the aircraft used for non-EU air carriers [Regulation (EU) No. 452/2014]
(according to BGzLV):
- AOC
- Confirmation of insurance (in the case of air carriers from a third country, proof of Regulation (EC) No. 785/2004 on insurance requirements for air carriers and aircraft operators)
- Details and proof of the aircraft types to be used with the seating and freight capacities (CofA)
Changes:
If the company intends to make changes to the issued permit during the approval period, these must be submitted to Austro Control GmbH in writing for approval at least five working days before the planned date of the changed operation.
