Local Scenic Flights


For commercial local flight operations with aircraft falling within the scope of Union law ("CAT A to A" with "EASA aircraft"), the provisions of Regulation (EU) No 965/2012 (Part-ORO, Part-CAT and, where applicable, Part-SPA) shall apply. Accordingly, for the performance of commercial local flights, the existence of an Air Operator Certificate (AOC) together with the associated operations specifications (OpSpecs), each issued by Austro Control GmbH, is a prerequisite.
It is not necessary to obtain an operating license in accordance with the requirements of Regulation (EC) No 1008/2008.

For commercial local flight operations with "non-EASA aircraft", i.e. with aircraft according to Annex I of Regulation (EU) 2018/1139, for which a certificate of airworthiness according to Annex 8 of the Convention on International Civil Aviation has been issued and which are entitled to cross-border flights in international air traffic, the provisions of the AOCV 2008 (in particular its Annex 3), which for the most part in turn refer to the applicable provisions of Union law, must be followed. A prerequisite for the admissibility of such flights is a (national) AOC including OpSpecs issued by Austro Control GmbH.

Notwithstanding the foregoing, prior to the issuance of both a Union law and a national local flight AOC, an approval of commercial operations issued by the Federal Minister for Climate Protection, Environment, Energy, Mobility, Innovation and Technology (BMK) must be obtained in accordance with national law (Sections 102 and 104 ff of the Austrian Aviation Act).
