Application for granting an approval to conduct commercial operations - Federal Ministry for Climate Action, Environment, Energy, Mobility, Innovation and Technology (BMK) (§ 104 LFG)

In the application for granting an approval to conduct commercial operations, the applicant shall provide evidence of sufficient financial means for the establishment and operation of the company.

The application shall include:
  • surname and first name (company), address (registered office) and principal place of business of the company,
  • name, city and citizenship of the persons authorised to represent the company,
  • planned scope of operation = passenger flights, aerobatic flights, sailplane towing with TMG,
  • the intended geographic areas, i.e. the area covered by the intended operations,
  • the intended number and type of aircraft,
  • the intended operational organisation.

Following the approval of commercial operations issued by the Federal Ministry for Climate Action, Environment, Energy, Mobility, Innovation and Technology (BMK) the operator shall declare compliance with the applicable requirements laid down in Annex V of Regulation (EU) 2018/1139 and the requirements laid down in Regulation (EU) 2018/1976. By declaration the operator additionally confirms to allocate adequate resources to fulfil all legal responsibilities related to the operation of sailplanes.
Operation may only be commenced after submission of this declaration.

Within 10 days of receipt of the declaration Austro Control GmbH will issue a confirmation of receipt to the operator. A copy of the declaration shall be carried on board.
The continuous oversight of an operator by the aviation authority is intended to contribute to the safety of operations and to ensure that the applicable legal regulations are complied with. 
The following procedures are used to exercise oversight:
  • Audits
  • Inspections (announced / unannounced)
  • Other reviews
In addition to the scheduled oversight of CAT operators, the above-mentioned procedures may also be applied due to specific events at the discretion of the authority.
Operators of sailplanes which are not registered in Austria but are operated predominantly within Austrian territory shall submit the following notification to the authority before commencing operations:
